"In reviewing the judgments of the federal courts of appeals during the October Term 2011 ('OT11'), the Supreme Court affirmed only 20 percent of the time. The year before, only 28 percent.2 The circuit courts, it would appear, have a lousy batting average. But appearances can be deceiving."
